Your access to and use of the Services is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Services.

By accessing or using the Services, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the Services.

1 Accounts

When you create an account with us, you guarantee that you are above the age of 13, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Services.

You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

2 User-Generated Content

Our Services allow you to post, link, store, share, and otherwise make available certain information, text, graphics, videos, or other material ("Content"). You are responsible for the Content that you post on or through the Services, including its legality, reliability, and appropriateness.

By posting Content on or through the Services, you represent and warrant that: (i) the Content is yours (you own it) and/or you have the right to use it and the right to grant us the rights and license as provided in these Terms, and (ii) the posting of your Content on or through the Services does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person or entity.

You retain any and all of your rights to any Content you submit, post, or display on or through the Services and you are responsible for protecting those rights. We take no responsibility and assume no liability for Content you or any third-party posts on or through the Services.

However, by posting Content using the Services you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the Content in connection with the Services and our business, including for promoting and redistributing part or all of the Services.

3 In-App Purchases and Subscriptions

Some parts of the Services require a paid purchase to access premium features. We offer the following purchase options:

a. One-Time Purchases (Lifetime Access)

Certain premium features may be available through a one-time purchase ("Lifetime Access"), which grants permanent access to those features without recurring charges. Lifetime Access is non-refundable except as required by applicable law or the refund policies of the applicable app store (e.g., Apple App Store, Google Play Store).

b. Recurring Subscriptions

Some parts of the Services may be billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a Subscription.

At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or Outside The Pan cancels it. You may cancel your Subscription renewal through the respective app store's subscription management settings (e.g., Apple App Store, Google Play Store).

c. General Payment Terms

All payments are processed through third-party payment processors, such as Apple or Google. Outside The Pan does not directly collect or store your payment information. You shall provide accurate and complete billing information to the applicable payment processor.

Refunds are handled in accordance with the refund policies of the applicable app store. To request a refund, please contact the app store through which you made your purchase.

4 Prohibited Uses

You agree not to use the Services:

• • In any way that violates any applicable national or international law or regulation.
• • For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content or otherwise.
• • To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail", "chain letter," "spam," or any other similar solicitation.
• • To impersonate or attempt to impersonate Outside The Pan, a Outside The Pan employee, another user, or any other person or entity.
• • In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity.

5 Intellectual Property

The Services and their original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Outside The Pan and its licensors. The Services are protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Outside The Pan.

6 Disclaimer of Warranties; Limitation of Liability

The Services are provided on an "AS IS" and "AS AVAILABLE" basis. Your use of the Services is at your sole risk. The Services are provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

In no event shall Outside The Pan, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; (iii) any content obtained from the Services; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

7 Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which the company is established, without regard to its conflict of law provisions.

8 Third-Party Terms and Beneficiaries

You acknowledge and agree that these Terms are solely between you and Outside The Pan, and not with Apple Inc., Google LLC, or any other app store provider ("App Store Provider"). Outside The Pan, not the App Store Provider, is solely responsible for the App and the content thereof.

The App Store Provider has no obligation whatsoever to furnish any maintenance or support services with respect to the App. To the maximum extent permitted by applicable law, the App Store Provider will have no warranty obligation with respect to the App.

Outside The Pan, not the App Store Provider, is responsible for addressing any claims relating to the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Outside The Pan, not the App Store Provider, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

The App Store Provider and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, the App Store Provider will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

9 Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Services.
